What is PEP (politically exposed person)

Art. 36 (2) For the purposes of para. 1, Politically Exposed Persons (PEPs) are natural persons who are or have been entrusted with the following prominent public functions:

1. Heads of State, Heads of Government, ministers and deputy or assistant ministers;

2. Members of parliament or of other legislative bodies;

3. Members of constitutional courts, supreme courts, or other high-level judicial bodies whose decisions are not subject to further appeal except in exceptional circumstances;

4. Members of courts of auditors;

5. Members of the governing bodies of central banks;

6. Ambassadors and heads of diplomatic missions;

7. High-ranking officers of the armed forces;

8. Members of the administrative, management, or supervisory bodies of state-owned enterprises and companies wholly owned by the state;

9. Mayors and deputy mayors of municipalities, mayors and deputy mayors of districts, and chairpersons of municipal councils;

10. Members of the governing bodies of political parties;

11. Directors and deputy directors of international organizations, members of management or supervisory bodies of international organizations, or persons performing quivalent functions within such organizations.

(5) For the purposes of para. 1, “related persons” shall mean:

1. Spouses or persons living in a de facto cohabitation equivalent to marriage;

2. First-degree descendants and their spouses or persons with whom the first-degree descendants live in a de facto cohabitation equivalent to marriage;

3. First-degree ascendants and their spouses or persons with whom the first-degree ascendants live in a de facto cohabitation equivalent to marriage;

4. Second-degree relatives by collateral line and their spouses or persons with whom such second-degree relatives by collateral line live in a de facto cohabitation equivalent to marriage;

5. Any natural person known to be a beneficial owner jointly with a person under para. 2 of a legal entity or other legal arrangement, or who has other close business, professional, or commercial relationships with a person under para. 2;

6. Any natural person who is the sole owner or beneficial owner of a legal entity or other legal arrangement known to have been established for the benefit of a person under para. 2/
